1. About these terms
These Terms govern your use of the AEKO Pay website, application, account and related services provided by AEKO Pay CC, a close corporation registered in Namibia. By creating an account or using the Services, you agree to these Terms and confirm that you have read the Privacy Policy.
Additional product mandates, disclosures and agreements may apply to a particular credit or payment transaction.
2. Eligibility and account registration
You must be at least 18 years old, be legally capable of entering into a contract, provide a valid Namibian mobile number and identification, and provide information that is accurate and complete.
You are responsible for keeping your PIN and device secure. Tell AEKO Pay promptly if you believe your account or credentials have been compromised.
3. Credit assessment
AEKO Pay may assess identity, affordability, bank-statement and other information to decide whether to offer credit and what limit may apply. A displayed limit is not a guarantee that a transaction will be approved.
Your assessment may be reviewed when information changes, documents expire, repayments are made or risk controls require a reassessment.
4. Transactions and separate agreements
Each financed purchase is subject to approval and may be governed by a separate written credit or loan agreement and repayment schedule. Review that agreement before confirming a purchase.
Merchant goods and services remain the merchant’s responsibility, subject to applicable law and any rights you may have against AEKO Pay.
5. Repayments, fees and arrears
Amounts due may be collected from your linked bank account in accordance with your mandate and transaction agreement. You must ensure sufficient funds are available on the due date.
Interest, transaction charges, default consequences and collection steps will be disclosed in the applicable agreement and must comply with Namibian law.
6. Acceptable use
Do not use AEKO Pay for fraud, unlawful activity, false identity information, prohibited goods, interference with the Services, or transactions intended to evade limits or controls.
We may decline, suspend or investigate activity where required to protect users, merchants, the platform or comply with law.
7. Documents, identity and privacy
You authorise AEKO Pay to process documents and identity information needed to provide the Services, prevent fraud, meet legal obligations and administer your account. The Privacy Policy explains how this information is used and protected.
Document and biometric-related processing may require additional consent or notices where applicable.
8. Service availability
We aim to keep the Services available but cannot guarantee uninterrupted operation. Maintenance, network failures, fraud controls, partner systems and events outside our control may affect availability.
9. Limitation and complaints
Nothing in these Terms excludes rights or liability that cannot lawfully be excluded. To the extent permitted by law, AEKO Pay is not responsible for indirect loss arising from unavailable services or matters outside our reasonable control.
Questions or complaints may be sent to support@aekopay.com. We will handle complaints fairly and in accordance with applicable Namibian requirements.
10. Changes, termination and governing law
We may update these Terms and will provide notice where required. Continued use after an effective update means the revised Terms apply. You may stop using the Services, subject to outstanding obligations.
These Terms are governed by the laws of Namibia. Namibian courts have jurisdiction, subject to any mandatory dispute-resolution process.
